Clarity Amongst Complexity: Dilapidations at HartDixon

Within the realm of property management, dilapidations can often appear as a complex, costly, and drawn-out challenge. However, with the right expertise, timing and commerciality, these claims can be resolved efficiently and effectively.

Whilst underwritten by legal processes and case law, the dilapidations process should not be highly litigious nor overly protracted. It is as simple as agreeing a commercial settlement taking all factors into account, and we firmly believe proactive and constructive negotiations can secure such settlements.

HartDixon’s approach to dilapidations concentrates on strategic planning and client focused outcomes. We aim to provide clear and commercial advice to ensure both landlords and tenants can navigate the process with ease and efficiency, to secure the most commercially viable exit that is available.

Our Approach to Dilapidations

At HartDixon, we believe successful dilapidations management starts with early involvement and strategic foresight. Our specialised team is dedicated to simplifying the process, offering tailored services that align with our clients’ objectives. Whether representing landlords or tenants, we bring extensive technical knowledge and market insight to every project, ensuring that claims are settled on a commercial basis.

Our comprehensive dilapidations services cover every aspect of the process with precision. We specialise in preparing and negotiating terminal and interim Schedules of Dilapidations, ensuring that all parties are fully informed of their obligations. Through meticulous assessments, we aid clients in accurate budgeting, helping them to anticipate costs and avoid unexpected financial burdens.

Beyond assessments, we offer strategic advice on complex issues such as lease breaches and break clauses, guiding our clients through potential pitfalls while safeguarding their interests. In managing and monitoring dilapidation works, we adopt a hands-on approach, ensuring full compliance with legal and contractual requirements. Whether it be the acquisition of a company with a need to review potentially inherited dilapidations liabilities to traditional negotiations on a lease termination, we invest time to understand what is needed and tailor our services accordingly.

Chelmsford dilapidations claim leading to contract administration services

HartDixon’s expertise was instrumental in supporting our clients with industrial units in Chelmsford. For the first unit we prepared a terminal schedule of dilapidations and successfully negotiated a settlement on behalf of the landlord. We then managed the contract administration for significant reinstatement and refurbishment works, incorporating sustainable features such as VRF heating, LED lighting, solar photovoltaic panels, and electric car charging points. These upgrades not only met the client’s specifications but also improved the building’s EPC rating to an A, significantly enhancing its value. These upgrades all needed to be reflected in the dilapidations claim, but knowing what is potentially claimable and what is not at an early stage is essential to informing work budgets and provisions. Just because there is a refurbishment, does not mean works cannot be claimed.

On an additional unit, we negotiated a dilapidations claim with the outgoing tenant and managed the necessary repairs, facilitating a successful long-term re-letting of the premises. Our expertise in both dilapidations and logistics enabled us to maximise the asset’s potential, delivering substantial value to our clients.
