There were significant changes through the lease history including assignments and sub lettings along with existing Tenants wishing to remain where sublet. Through careful negotiation and gaining a full understanding of the letting position and future Tenants requirements, we crafted an exit strategy which minimised exit costs, but also helped the landlord secure a future Tenant. Considering all commercial angles is very important in dilapidations claims. Helping to facilitate future lettings and achieving landlord aspirations (even as a Tenant) will often result in lower exit costs for Tenants. Beware of a belligerent and aggressive stance in dilapidations negotiations as they do not necessarily achieve the best outcome, although can be adopted where required as one of many strategies to consider.
